By Jeanna Pool There are basically two ways in which you can either attract or repel prospects. I call these Attraction Marketing and Repel Marketing. You can either attract or repel prospects in your traditional marketing activities…such as: networking, direct mail, your web site, your brochure, your business graphics, your product or services, etc… You can also attract or repel prospects in your invisible marketing…such as: the way you present yourself, your attitude, the tone you use, subtleties in the way you run your small business, your thoughts, your actions, your motivation, etc… Think of a person who is cocky and a know-it-all. “I am great, I am the best, I have the most experience, I am the one you should work with. You would be crazy not to work with me, hire me, pay me, my advice is right, you’re wrong, you don’t know what you’re talking about”…and on and on and on… Turns you off, doesnt it? Kinda makes you sick, hu? Big case of Repel Marketing. Essentially you are repelling the prospect just as this know-it-all person repels you. Now, think of the person who’s empathetic, who listens and cares…whom you can call at 2:00am with a problem to find understanding and a listening ear. When that person offers advice, you listen because you trust them. They know how to help since they have heard you instead of trying to force their ideas on you. Makes you feel important, doesn’t it? Kinda makes you want to spend more time with them, hu? Great case of Attraction Marketing. Essentially you are attracting the prospect just as the empathetic, listening, caring person attracts you. Obviously, Attraction Marketing is the way you MUST market your small business. By incorporating Attraction Marketing, your prospect is attracted to you. Your prospect wants to be around you. Your prospect trusts you. Your prospect feels comfortable with you. And your prospect buys from you. If you are not attracting clients or customers, you are probably being a Repel Marketer. I hear you saying, “Who me? How could I possibly be a Repel Marketer?” Its actually easier to be a Repel Marketer that an Attraction Marketer. Being an attractor takes empathy, listening, concentration, care and concern. Being a Repel Marketer is easy…just be lazy and do everything half-hearted and I can guarantee…your pretty much there. Let’s discuss Repel Marketing in some detail. If you avoid these “guaranteed repellants”, you should be able to make sure you are more of an attractor. Repel Marketing Most small businesses that are repelling clients usually don’t know what’s going on or why they aren’t getting more business. The problem can be very hard to notice, because it is usually invisible or at least very subtle. For example: How do you present yourself for face-to-face meetings with prospects? Do you look professional? Or, do you look like just crawled out of bed? No, I’m not talking about wearing a three-piece suit here…unless, of course, its appropriate for your industry or area of expertise. What I am talking about specifically, is that you MUST be professional in your appearance and look appropriate for your industry or you will repel rather than attract clients. Are you on time to your meetings? Or, do you keep the prospect waiting? When something makes you late, do you call to let them know you are on your way, or do you show up 20 minutes late and offer an excuse? Everyone’s time is valuable. Being even 5 minutes late can be seen as rude to some. Are you repelling rather than attracting by not treating your prospects time as a priority? What’s your telephone demeanor? When you talk business on the phone, do you focus all your attention on the caller? Or, do you talk to others at the same time, place the caller on hold indefinitely, shout into the receiver, drift away inattentively or type an on your computer? Are you repelling rather than attracting by being distracted and unprofessional on the phone? What about the noise factor on the telephone? Have you ever tried to talk business with someone only to be interrupted by distracting sounds coming from their end of the line? Sounds like screaming kids, a roaring vacuum cleaner, loud TV’s, or retail announcements of what’s on sale on aisle 5… Are you repelling rather than attracting by trying to do business around chaotic noises? The examples above are invisible or subtle ways you may be a repeller. But, there are obvious ways that you may be repelling clients too… For example: The Internetsad, but trueoffers small business owners a great way to repel customers. How does your web site look? If your web site looks like it’s just been thrown together, then that’s how people see you and your business. It’s not a very flattering much less, a professional image. A worldwide audience sees your web site. What does yours say about you? Does it show people that you’re too cheap to hire a professional to design it or too cheap to even care how it looks? What about your web site’s content? Is it informative? Is there enough information to give prospects a reason to move closer to doing business with you? Or, does it talk all about younot the prospectand give superficial information about your services? Are you repelling customers and not attracting them, by having a sub-par web presence? How does your brochure speak to prospects? Does it address the prospect’s questions of “So what? Why do I need this? Who cares?” Or, does it just focus on how great you are and how many years you’ve been in business? The contentor lack of itin a web site or brochure can be a big repeller. Attraction Marketing There are 3 key concepts that you must incorporate into both your traditional marketing and invisible marketing to make sure you are an attractor. 1. Listen to your prospects Understand their problems. Empathize with their fears. You should listen 70% of the time and speak no more than 30% of the time. Aren’t you attracted to people who listen to you? 2. Speak directly to the prospect’s issues and concerns Talk about them, more than you talk about yourself. Answer the “so what’s, who cares and why should I make a move?” Aren’t you attracted to people who don’t make life “all about them”? 3. Let the prospect know exactly how you can help them Articulate clearly. Let them know exactly what they will get and what they can expect. Aren’t you attracted to people that don’t spring unwanted surprises on you? You already know if you’re attracting clients. Now you know some of the reasons why you are repelling them. If you’re not an Attraction Marketer, then take an honest look at yourself as a small business ownerboth in your traditional marketing and invisible marketing. Look at things from your prospect’s point of view. Would you genuinely be attracted to doing business with someone like you? Or, would you be repelled at the thought of spending money with a business like yours? If you have to give this even a second thought…then, it’s past time to stop being a repeller. 3 Ways Of Escaping TUPE 2006 Service Provision Change Transfers

By Ian Mann The Transfer of Undertakings (Protection of Employment) Regulations 2006 now applies to service provision changes in circumstances where a client who engages a contractor to do work on its behalf is either reassigning such a contract or bringing the work in-house’. There are two exceptions. It will not be a service provision change if the contract is wholly or mainly for the supply of goods for the client’s use, or the activities are carried out in connection with a single specific event or a task of short-term duration. The effect of TUPE 2006 on the service provision change is therefore that employees will be entitled to transfer on the same terms and conditions as they enjoyed with their original employer upon a transfer of the service as a result of changes in contracting out or contracting in. The absurdity of TUPE 2006 is that many businesses will want to retain a stable workforce and retain their employees when they cease to provide services to a particular client. There are some obvious precautions and measures that may be used by “clients” and their contractors to avoid TUPE 2006 from having any effect. The following solutions are of course largely untested because the reality is that TUPE 2006 has yet to be fully examined in the courts. Encouraging objections by departing employees The first method for avoiding the service provision change provisions is to encourage the use of the objection by potentially transferring employees. Some businesses will adopt practical measures to provide incentive to their employees to remain with them, even if they technically should transfer to the client’s new service provider. In some cases clients may select especially valuable employees by encouraging them to object to the transfer pursuant to regulation 4(7).Once this occurs of course the client will have to re-negotiate new contractual arrangements with them. Quota protection to avoid a service being deemed an organised grouping of employees Secondly, it will also be open to businesses to put in place systems to ensure that no employee or group of employees becomes dedicated to a particular client (whether exclusively or not) in the provision of services. After all, TUPE 2006 will not apply to service provision change where employees are not working in a single economic grouping. The DTI guidance explains that the team should be essentially dedicated to carrying out the activities that are to transfer (though they do not need to work exclusively on those activities)’. Sophisticated end users will impose conditions in their contracts for supply of services. These contracts may include a requirement that no employee engaged in the activity in question should spend more than a certain percent of their working time on that activity, and including appropriate warranties and indemnities from the supplier. Clients may also seek to identify in new contracts the specific employees they do and do not want to carry out work on their behalf, although new contractors may factor into the price the costs of dealing with any unwanted’ transferring employees. This is a far more sophisticated model than entering into a series of one-off contracts because the court is likely to cut through a contractual device where the one-off contacts are in fact using the same employees in the same service provision to a dedicated client. Such a quota system may very well cause problems in terms of quality of service, particularly where the client relationship is important for the delivery of a good service. This is because in reality by increasing the number of or frequently switching between suppliers quality may decrease. The advantages of doing this would have to be weighed up against any disadvantages such as losing continuity and the detrimental effect on the client/supplier relationship. This will be a delicate assessment depending on the nature of the service. The Secondment Route The third method is to create a secondment situation. Similar to the objection method it involves the objection by employees to a transfer which allows the employee to remain in the formal employment of the original client although not continuous. Additionally, the employee is seconded to the new contractor. Once on secondment any further transfers will be avoided by regulation 4(1) which states that employees transfer under TUPE 2006 if their contract of employment “would otherwise be terminated by the transfer.” There can of course be no termination by virtue of a transfer to an employee is only seconded. This has been used by the NHS in Private Finance Initiatives (PFI) in order to allow NHS employees to have the benefit of a NHS pension whilst being seconded to a private contractor. Whether you serve plaintiffs, defendants or both, you’re probably already familiar with FEA. Simply put, if a loss, injury or death is due to something bending or breaking, FEA can help explain the failure. An experienced FEA expert can determine the stresses and displacements in the failed part. When compared to industry standards, earlier designs and competitive designs, this often identifies the cause of failure, and hence the responsible party. As in any field, your choice of an expert is important in making your case. Every now and then, no matter how close and intimate a couple is, an argument occasionaly looms to create a tide in the relationship. Although sometimes it shakes a relationship down to its very core, if handled well, it is healthy and can help create lasting relationships. Here is a list of what couples like you usually argue about and what you should do whenever you are faced with another petty bickering. Jealousy Jealousy is a natural human emotion. It is not negative in itself. How people react to jealous feelings make it negative. Usually, jealousy stems from the lack of trust or lack of assurance from one’s partner. It can also come from a low self-image or an inferioriy complex. If you’re the jealous one, learn to act by reason and not by emotion. Depending on the expectations you may want to concede in your relationship, it is highly commendable that you bring your expectations upfront from the very start of the relationship. Determine which expectations are most important to you and which are most important to your partner. Spend some time tossing around what you both desire and need from the relationship and what you must have and won’t tolerate from each other. Remember, love works best when it involves both give and take. You’re-Wrong-I’m-Right Attitude Instincts often tell us not to give up and admit defeat in times of disagreements especially if we are certain that we are right. But come to think of it, does it really matter who’s right and who’s not? In a relationship, it is never good to assert too much if it means you could hurt your partner. Let go of having to “be right!” If you must speak up, do it lovingly. Never tell your partner that he is wrong straight in the face. If you do this, you may just stir a storm in a teacup and set about a violent outburst. Instead of having to be RIGHT, decide between your mate that it is more important to be HAPPY. Discuss in a loving way areas of mutual concern then agree on certain terms so that you prevent yourselves from meshing with future disagreements. Money Matters When you’re going through the honeymoon phase of your relationship, money may not be much of an issue. Nonetheless, as the relationship progresses, power struggles and control issues around money may just start surfacing. This creates tension that if not resolved, can put a serious damper on the relationship. Where critical differences exist in your financial expectations, try to negotiate.
